Pursuing a claim for damages

To pursue a clinical negligence claim, the following criteria must be met:

The Negligence

You discover you have suffered an injury as a result of medical care. We’ll then take instructions from you to assess the viability of the claim.

The claim

We investigate your claim. This is likely to involve obtaining medical records and instructing one or more medical experts. If the investigation supports your claim, we will submit details to the medical practitioner, Trust and/or Health Board. Evidence will be obtained to help us to value your claim.

The negotiation

We will strive to negotiate a suitable settlement, but where this is not possible, it may be necessary to take the case to Court. Not all Court cases are determined by a Judge; many are settled during the Court process.

The settlement

After a successful claim, you will receive your compensation.
