BDE Law can advise you on a variety of different ways to fund your claim

One of the most important questions you are likely to have will be: “How will I pay to bring my claim?”. If you're concerned about how you'll pay to take your claim forward, we have a variety of funding options which we can offer. 

We will advise you in detail at the beginning of the process but funding will depend upon whether you already have legal expenses insurance (LEI). We can help you to find out if you have LEI or funding via your Union or credit card provider. Legal aid (or public assistance) is generally not available; it may be available for limited types of medical negligence claims.

  • If you have LEI, this protects you against paying the costs involved in legal cases, for example, solicitors’ costs, medical expenses, etc. You need to have a reasonable chance of your claim being successful and we will advise you fully on this, as well as on any other terms and conditions that may affect your cover. We’ll obtain a copy of your policy and check it covers the claim and is adequate.

  • If you do not already have LEI, we can make other arrangements. You’ll see that funding of your claim can be risk free, even if you do not already have LEI, so that you would pay nothing if you lose.
    • To cover our costs, you may be able to enter into a Conditional Fee Agreement (CFA) with us. This is a contract between you and us which allows us to reclaim costs from your opponent when your claim ends. It is otherwise known as a ‘No win, No fee’ agreement.
      • You may be liable for some of the costs, and/or expenses of your claim if you win depending on the circumstances. But we will advise you if you are wholly to be liable or if your liability can be capped.
    • To cover any other expenses and your opponent’s costs, we can help you buy after the event insurance. This is entirely optional - and you pay nothing upfront.
      • The premium is paid from the compensation you receive, save in the case of claims for medical negligence, when the majority of the premium may be reclaimed from your opponent. This policy may also cover you against the premium, if your claim is unsuccessful.
  • In a limited number of cases where CFA’s are not available, we will consider taking a share of your compensation to cover our fees.
  • We will advise you about your funding options, so that you can decide what is best for you, when we first discuss your case.
